website hosting

The client should understand that the hosting of the client's web site with a hosting service is under a separate agreement, and may require annual fees. The choice of hosting service remains with client, as does the responsibility of keeping hosting fees up to date. The client agrees to select a hosting service that will allow eighteenthree complete access to the web site directories, cgi-bin directories and any other resources provided by the hosting service deemed to be necessary to install and fully implement the web site. eighteenthree is happy to advise on web hosting issues.

domain name renewals

If any domain names are included in your project, these domain names will be renewed automatically on a yearly basis until eighteenthree are instructed otherwise. Renewal charges for all domains will be invoiced automatically. Instructions to cancel domain names must be received by email at least 30 days before the renewal date, otherwise the domain name(s) will be renewed automatically and will be invoiced as such.

website content

The client will provide all graphics and text to be included in the web pages. eighteenthree is not liable or responsible for any errors, omissions, or actions arising from the publishing of incorrect information received from the client.

The client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks or other material supplied to eighteenthree for inclusion in the web site design are wholly owned by the client, or that the client has permission and authority to use each of these elements. Furthermore, eighteenthree will not be liable from any claim or suit arising from the use of such design elements as supplied by the client.

Our search engine service involves submitting your site to third party search or directory sites once only. It is the responsibility of the client to market and promote their own website, and no guarantees are given that your site will be given a high ranking within any particular search directory. If guaranteed results are required, we can recommend search engine submission companies, who can offer a guaranteed search engine placement service. Search engine submission will only take place after full payment has been received.

Your website will be designed primarily for use in the latest versions of Edge, Chrome, Safari and FireFox. If you require that your site be designed and tested for older versions of these browsers, or for other browsers, this should be made clear before we begin work on the site. eighteenthree can not guarantee that your website will work with any future browser releases, although every care will be taken to ensure full compatibility.

payment of fees

Website design fees payable to eighteenthree are due and payable on the following schedule:

50% of the fee is payable upon entering into any website project. This is non-refundable, as it covers our set-up costs and initial work, even though such work may not be visible to the client. The minimum deposit amount is £200.

Should the full website design charge be £250 or less, the full amount will be payable before the project starts.

The remaining 50% of the fee is payable when the web site has been constructed according to the client's instructions. If the full balance has not been paid within 21 days of completion of the site, the site will be suspended until payment is received, and reinstating the site may then incur additional administration charges. If no feedback or further instruction is received from the client within 14 days of site completion, this will be taken as agreement that the work done conforms with the client's wishes, and the remaining balance will become due.

All graphic design fees are paid up front at the start of the project.

All invoices issued by eighteenthree must be paid within 21 days of the invoice date. If the invoice remains outstanding more than 21 days from the date of the invoice, the web site or any other files to which the invoice relates will be removed or suspended until the payment is received.

In the event that the client cancels this agreement before the completion of the web design project, all work done up to that point will remain the property of eighteenthree, and any deposit paid will not be refunded.

In accordance with eighteenthree's guarantee of providing the client with the best web design quote, if the client can provide evidence of a cheaper quote for web design work of the same scale and content before entering into a design agreement with eighteenthree, then the quote from eighteenthree will be adjusted to match or better that cheaper quote.


Both eighteenthree and the client agree to work together to complete the web site and its full implementation in a timely manner. A proposed timescale will be agreed upon before work commences on the site.

Although eighteenthree will undertake every effort to ensure completion on or before the agreed date, eighteenthree agrees to notify the client at the earliest possible time of circumstances that may mean that the project will fall behind schedule.

Should any schedule or agreed date of completion of the web site include submission of materials by the client to eighteenthree (page text, graphics, logos, etc), then the client must provide these on time or eighteenthree cannot be held responsible for any delays in completing the site.


It is the responsibility of the client to back up all website or graphic files, or emails connected to any domain name and email accounts.

We strongly advise all clients to maintain regular backups.

updates and maintenance

As part of our web design service, eighteenthree will perform updates and maintenance of the completed web site for six months after the start of a design project. The start of the project is taken from the date of receipt of the client's deposit.

This covers minor changes and alterations to the site for the first six-month period, including changes or additions to text and/or graphics/photographs, but not including a redesign of page layout or style. Large scale alterations, updates and/or changes beyond the six-month period will be charged at our standard hourly rate.

eighteenthree may, at the end of the six-month period, enter into a further agreement with the client for ongoing site maintenance and upgrades, or may provide reasonable level of instruction to enable the client to maintain the site.
